Petroleum Act and Rules

The Petroleum Act 1934(and Rules framed there under in 2002) is Central Act. No one shall import, transport or store any petroleum products without a valid license under this Act.

District Authority or District Magistrate shall grant NOC (No - objection Certificate) for storage of following petroleum products for retail or self consumption.

1) Petroleum Class “A”

2) Petroleum Class “B”

3) Petroleum Class “C”

The District Magistrate means and includes an Additional District Magistrate.

Grant of No – Objection Certificate

The Applicant shall apply for grant of NOC to the District Authority along with the prescribed form IX and the District Authority shall complete his inquiry for grant of NOC as soon as possible but not later than three months from the date of receipt of application from him (rule 144 (5)).

Documents to be enclosed

The Applicant shall enclose the following documents while applying for issue of NOC.

1) Application with prescribed form (Form IX)

2) Documentary proof for a title over the land

3) Two Copies of site plan.

4) Letter of Intent.

Points to be considered by the District Authority before issuing NOC

(a) The lawful possession of the site by the applicant including authorization from land owner or lease holder for developing premises under these rules for storage of petroleum products;

(b) Interest of public, specially the facilities like schools, hospitals or proximity to places of public assembly and the mitigating measures, if any, is provided;
