Explosive Act
An Act to regulate the manufacture, possession, use, sale, [transport, import, export of explosives], transport, and possession for sale or use of explosives.
- District Magistrate is the Competent Authority to Grant license (rule 99), Transfer of license (rule 108), Amendment of license (rule 109,110& 111), Renewal of license (rule 112), Refusal to grant of license (rule 114), Suspension and cancellation of license (rule 118) for certain quantity and class of Explosives as mentioned in the Schedule IV and Part-1 of the Explosives Rules, 2008.
- Chief Controller / Controller of Explosives is the Competent Authority to to Grant license (rule 99), Transfer of license (rule 108), Amendment of license (rule 109,110 & 111), Renewal of license (rule 112), Refusal to grant of license (rule 114), Suspension and cancellation of license (rule 118) for certain quantity and class of Explosives as mentioned in the Schedule IV and Part-1 of the Explosives Rules, 2008. Provided that “Controller of Explosives” also includes the Joint Chief Controller of Explosives, Deputy Chief Controller of Explosives, Controller of Explosives and Deputy Controller of Explosives (see rule 2(14))
- As per the Explosives Act, 1884, District Magistrate means and includes Additional District Magistrate, Commissioner of Police and Deputy Commissioner of Police.
Classification of explosives
a.The explosives are classified into 8 classes as per Part-I of Schedule-I of The Explosive Rules, 2008 as follows,
- Class 1- Gunpowder class
- Class 2- Nitrate mixture class
- Class 3- Nitro-Compound Class
- Class 4- Chlorate-Mixture Class
- Class 5- Fulminate Class
- Class 6- Ammunition Class
- Class 7- Fireworks Class
- Class 8- Liquid Oxygen Explosive Class.
b.The Fireworks are classified into the following categories,
- Soundemitting fireworks
- Coloror light emitting fireworks
